I am hoping to Chapter 7 my overwhelming credit card debts. I don't have any asset that anyone would want, even my computer is a POS. But I have a land contract to buy some land, and it's $100 a month--very cheap. One day, when I am not poor, I'll put a trailer on this land. Otherwise, I live with my parents when I am not abroad working. The question: do you'all think my land contract is safe from the trustee?thanks!

What bankruptcy can give you is the automatic stay provision, which can temporarily stop all collection activities against you, including eviction. As to that contract, it may be an issue of if it's an executory contract - unfulfilled - and so the creditor can petition for the stay to be lifted. Do consult with a bankruptcy attorney to be sure.

I am hoping to Chapter 7 my overwhelming credit card debts.-- Hi you don't have to file bankruptcy for unsecured debts. You can instead do either credit counseling or debt settlement.

For overwhelming credit card debts, aside from professional debt relief programs, you can also do a d.i.y. debt relief - what sort? you can try doing a balance transfer - how? before you transfer to a bank with a better offer - ask the ff questions -1. Until when is the introductory rate or how long does it last? 2. What is the card's annual percentage rate after that introductory rate expires? 3. Does that introductory rate apply to transferred balances or just to new ones, or both? 4. Does that card have an annual fee? 5. Do they charge late fees and over-the-limit fees? 6. Are there balance-transfer fees?

How to settle credit card debt that's over $10 000? - d.i.y.If you are not yet past due or behind on your accounts - stop your monthly payments, until you fall behind. Creditors don't negotiate.Brace yourself for the creditor calls - ignore those because in 6 months time, they are required by the law to write off the account, and they usually turn over the account to collection agencies. (you try to settle with them instead of the creditors)Make an offer that you can afford. Start with a very low percentage, lower than 50% and expect it to be refused. You make another one, it might get refused too. The longer your debt sits there, the cheaper its worth become.Take your time.Tell them you're filing bankruptcy. If they budge, make sure to get everything in writing before you send in payment.
