Hi there,
"could you advice please, what's best for a retiree - debt counseling or bankruptcy?" - it would depend on what type of debt you are trying to eliminate, if it's unsecured - or credit card debt...might as well do debt counseling as bankruptcy is very tedious.

I agree with golliwog with regards to debt counseling, however if you wish to file bankruptcy, you may want to see a financial adviser or a bankruptcy lawyer for assessment - to find out if you are insolvent, if which chapter is suitable for you, to see about exemptions, etc.

Hello - since we do not know the specifics of your situation - here's a quick background on debt counseling. There are two types: (and these are only for unsecured debts like credit card) 1) Credit Counseling (deals with your interest rates) and then 2) Debt Settlement (deals with the balance itself) --- However, since I don't think that you're worried about your credit standing, filing bankruptcy might not be such a bad idea. Just make sure you get professional help.

I agree - and know that in a Chapter 13 bankruptcy, you don't have to lose your properties, because it is a repayment plan. You also do not have to undergo that Means Test (income test for Chapter 7) ... because your income is your pension (I'm not sure if it's exempted in bankruptcy though...) - somebody please verify.

Debt counseling or bankruptcy - it's very hard to give advice or recommendation without knowing the particulars - and it's understandable that you don't want to share that online - the good news is that if you
fill out a form here at destroydebt.com you get to speak to a debt consultant FOR FREE and also be matched up to the right program/company for you.
