Debt split in divorce? It depends on whether you live in a community property state or not -- also, if the divorce is amicable or stormy ...

Okay, if you live in these states - you split your assets and liabilities with your spouse in even half (most likely):California,
Arizona, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, and Wisconsin.

I agree with the previous posts & it might give you a bit of a cheer to know that - even if you share the liability for the debt, generally speaking, there is such a thing as - "for the benefit of the community". Meaning if your spouse charged on that card, the purchase was for the both of you or your family ...

The people here would discourage you from filing bankruptcy if your debts are mostly unsecured ... there are alternatives to which.Having said that, might as well file a joint bankruptcy so the creditors won't run after the other spouse after the other has been cleared (if the other spouse filed "individually" that is).

Speaking of alternative debt relief programs - you can do:Debt settlement - if your debt amounts to $10,000 or more and your accounts are past due.Credit counseling (Debt Management Plan) - if it's less and you are current.

What does debt settlement do? Is that even legal? I heard that credit counseling is useless & debt settlement is a hoax.

Oh you must've seen that news about some debt settlement companies and New York's Atty. Gen. It's true that there are sketchy groups out there, which is also true with every industry - and to answer your question - is debt settlement is a legitimate program - it is.You just have to do your homework really and check out the settlement company that you are entrusting your finances on.
