No, wage garnishment is handed down by the court.
It goes through a process before the collection agency gets the right to garnish wages.

I agree with the previous poster, also, with wage garnishment are bank levy and property lien. Creditors/collectors/law firms are all after those, collectively known as a 'judgment.'

The consumer is going to be given a chance to either avoid being filed a legal action such as that or if already, defend against it.

But there is also such a thing as default judgment. If for some reason the consumer failed to communicate with the law firm/collection agency with regards to how to resolve the issue -- or the time to defend against it has expired, the court would hand down a default judgment.

However, if the consumer is just a victim of circumstances, he/she can dispute this judgment.

Can a collection agency threaten or use scare tactics to get me to admit to a debt or make me promise to pay?
