New York Statute Of Limitations On Debt Collection

Posted on October 28, 2009 at 4:53 am
Hi, just passing by. Could you tell me what the statute of limitations on debt collection in New York is?
Also, what to do with pesky collection calls?
One more thing, can somebody be thrown into jail for not being able to pay debt?

THANKYOU!

Talk to them once at least and find out what they're up to. If you you've gauged that the debt they are referring to is not yours, write them a cease and desist letter. If however, it might be yours, wait for their letter within 5 days after that first contact. That letter should tell you your debt amount, your creditor info, and what you can do to have that debt verified.

No, not unless it's fraud/crime related, and it was tried in a criminal court.

Also, you can review your rights under the FDCPA here:

I don't think there is and perhaps a more relevant question is, what does statute of limitations mean?

Answer:

"Laws enacted by every state which govern the time frame when a lawsuit must be filed, and beyond which the claim can no longer be made. Statutes of limitation differ from state to state and according to the nature of the claim."

Also, wasn't New York's attorney general in the news recently?

Yes, from what I gathered, the New York Attorney General Andrew Cuomo has had a number of debt settlement companies discontinue their operations for abusive practices against consumers. Can someone please verify this?
