what are collection attorneys and how are they different from just plain debt collectors? who's scarier? that's actually an interesting question..because i dont know the answer to that..as far as i know..there are two types of collection agencies: 1) assigned by the credit card companies .2) Debt buyers. I don't know about collection attorneys..but whatever they are, they do sound like the scarier ones..

I agree with x and y and to add to that once the collection attorneys has obtained judgment, they then would have the power to take action to obtain the money from the consumer - wage garnishment, bank levy, or property lien.Who's scarier?

Colleection attorneys are just what it says. They are attorneys that have been hired by a creditor to collect on your delinquent account. They collect on accounts that are just in collections and they collect on accounts that have judements already. They try and obtain your payment in full BEFORE they set up for wage garnishment or bank levy, etc. All of these actions are expensive and to save costs, they rather have payment from the debtor than to garnish. But, this is not to say they will not garnish. They will, and they will do it without hesitency! Best to make payment arrangments with this type of attorney. How do you ensure they are not out to scam you? They also are bound by the FDCPA and must adhear to it. You can ask for their "bar number" and then call your state bar association and ask if they are in good standing. In addition, they will be rated(may not be a member) but will still be rated by the BBB.
