a customer took me to court over a three piece suite , he wants his monies back , the court awarded him the case and ordered us to pay all costs . £1360 , i simply cant pay and this is the needle to break the camels back financially , i am at a loss as top what to do , i have written to the court for time to pay , will they give it me , i am currently paying instalments to vat ,tax and buisiness rates .............help

You must be from the U.K. I am not familiar with how a judgment is enforced there but I looked it up for you and found that it is possible for you to pay in installment. The court would send you a Response Pack - where you input your income and expenditure - then submit.Your creditors may:-accept your installment offer-ask for a higher amount as monthly payment-demand that you pay the judgment debt immediately

Of course the court would decide for both the consumer and the creditors - but what would be the court's basis for its decision?

Number 1, of course, is how much the consumer can afford based on his/her financial report. The consumer's proposal and how long it's going to take to clear the debt via that. The age and nature of the debt. Then the court would set the payment dates. If the consumer miss payments, the creditors have the right to ask the court to enforce the whole judgment (amount) via what they call a Charging Order.
