Tennessee Bankruptcy Public Records

Hi, I was wondering if for example, I file bankruptcy, would it appear in my public records? If so, for how long? I'm from Tennessee and you know how small towny some people's mentality is here...I wonder if I'd be discriminated. Thank you.

Well..whether or not you're from Tennessee, a bankruptcy is going to affect your credit history and yes it is going to be a matter of public record..for 10 years. However, you do not have to file bankruptcy if your debts are mostly unsecured, and if you really are not after its automatic stay provision.

I agree with peterpanamerican, and according to 11 U.S.C.,  Section 525 of the U.S. Bankruptcy Code and the FCRA (Fair Credit Reporting Act) you should not be discriminated-just because you have undergone bankruptcy. If ever you find yourself having a tough time with employment, with renting a new place, obtaining a loan or with your application for new credit it's probably because of your poor credit report...

Most debt experts would advice against filing bankruptcy, financial issues are on the rise..not just in Tennessee. To prevent yourself from worrying about your bankruptcy record being public...avoid filing bankruptcy all together. You have at least two alternatives depending on your debt type. There's credit counseling, if your debt amount is not that high but has high interest.
