Hello, if I file bankruptcy in Virginia, what properties can I keep? Are the rules in Virginia different from the other states?

Are you a resident of Virginia? Also you may want to consult with your bankruptcy lawyer on what exactly are your exemptions. Here's what I know though. For the mean time. There are two kinds of exemptions that the state of Virginia gives to consumers. The first option includes: Under the first exemption scheme, from federal bankruptcy laws, you can keep your home (and secondary homes) amounting to up to $20,200, you life insurance payments and unmatured life insurance contract-except credit insurance policy, life insurance policy worth $10,775, pensions and ERISA qualified benefits, alimony and child support.Under the second scheme: Your home, if you do not have more than $5,000 plus $500 per dependent in equity in the house, one motor vehicle, if you do not have more than $2,000 in equity, household furnishings, up to $5,000, tools and instruments up to $10,000, at least 75% of your earned but unpaid wages, and ERISA-qualified pension benefits of up to $17,500 per year. If you are a disabled veteran you are entitled to a special exemption of up to $2,000

Why are you filling bankruptcy? Are you getting collection calls? What types of debt do you have? Also bankruptcy does not wipe out voluntary liens, like mortgages and deeds of trust, or tax liens. You might still face a foreclosure after bankruptcy if you do not pay.
