When going to court if being sued what important documents should you demand from a debt collector besides a credit card application , card agreement, & credit card statements. Did I leave out any. Any advice on this would be apprciated.

What is your goal by showing up to the hearing? Are you trying to dispute the debt that is owed? Did you file an answer to the summons and complaint?

I would be prepared to have a tough time during that hearing unless you can prove that you are not actually liable for the debt. 99% of those cases are awarded to the creditor. Have you tried resolving the debt, perhaps through a settlement or payment plan? I assume you have already been summonsed?

yes, I have been summoned. I was told if you told show up, you will lose by default & that stays on your credit for 20 years. I live in NYC. Is that true? Even if they sue, there is nothing from me to take. I am what you call collect or judgment proof.

I have to show up to answer a complaint, it did not go to a actual hearing yet. I probably have to fill out papers.

Oh ok. Yes, you would file an answer to the summons and complaint- usually you have to bring that down to the local courthouse. After they process your answer they will set a court date. If you do not file an answer, they will get a "default judgment" against you. Make sure you file an answer on time. In most cases you are given 20-30 days to do so.

Yes I know, I will go on time that's for sure. I spoke to a few consumer debt lawyers about it. I am not going to let them win by default.
