how long does it take to refile bankruptcy? i mean, how long does one have to wait before filing another bankruptcy? especially if the previous case was dismissed?

How long does it take to file bankruptcy again?Okay here are the time frames:*
Start counting time from the date of filing to the date of filing - and not from the date of the first discharge to the date of the second filing.For Chapter 7s: 8 years in between For Chapter 13s: 2 years in between In between Chapters 7 and 13: 4 years In between Chapter 13 and 7: 6 years, that is if your plan is under 70% completed

You do not have to file bankruptcy again if your debts are mostly unsecured. Try exploring non-bankruptcy alternatives like credit counseling and debt settlement before filing bankruptcy again. It depends on the complexity of your case. A normal Chapter 7 case would probably get a discharge in about 3 1/2 to 4 months.

Just to clarify,In a Chapter 7 case, you are required to attend the creditors meeting which happens in about 4-6 weeks. 60 days after the conclusion of that meeting, unless the creditors files a motion or an objection, you are then eligible to receive a discharge. You can expect a copy of the discharge order in your mail by day 62 or 63.

You have other options - credit counseling (debt management plan) if you wish to have your interest rates negotiated and if your total debt amount is less than $10,000. Debt settlement if your accounts are past due and they total to more than $10,000.
