How can the consumer defend against a debt lawsuit in California, 'heard that the laws are somewhat different from the other states. How so? Thank you.

That's an interesting question k-pax-although I have another question, how did that lawsuit against a debt relief company in California go? Freedom debt relief, I think, in California..

I really don't know anything about the Freedom Debt Relief case except that I think it's about their use of a third party savings provider to save the client funds and when a consumer,  for example, looks into the company's BBB record, that lawsuit and other complaints would also show. Anyway some of the debt suits in California come from consumers who sue debt collectors for violation of their FDCPA rights. The California debt collection law puts substantial restrictions against debt collectors-- and the court can obligate them to pay the consumer $1,000, plus other damages, and lawyer fees if the consumer sues them and wins the lawsuit.

Debt relief companies in California, especially debt settlement companies, hire lawyer services to defend against client lawsuits. They also hire lawyer services if their clients case is legal in nature or has become complicated.Debt settlement companies in California are required to provide the consumers a detailed contract stating the following: an analysis of the consumer's case, an estimate of the fees that they are going to pay, the charges, also how long the program's going to last,  and other various other specific provisions and disclosures

Hi K-Pax, you can of course defend yourself against a lawsuit even if you're not in California. When it comes to debt though, you're probably referring to a judgment lawsuit brought upon the consumer by the creditor? One way to defend it or stall it is to file bankruptcy. The automatic stay provision of bankruptcy can stop all collection activities temporarily, but as for your debts, you'd have to pay them anyhow.

Why not share your story with more people? I'm sure it would help consumers learn more about companies like Freedom Debt California and how come it's facing a lawsuit.

Speaking of that California debt lawsuit, I fetched this on a Freedom Debt Relief complaints site:“Instead of their debts being settled or reduced, many of the defendants’ customers suffered increased debt because of late fees imposed by creditors, referral to collection agencies or collection lawsuits. Some customers ended up in bankruptcy, ” according to the suit.
