Did you mean to ask, how long does a bankruptcy take to discharge?Chapter 13 bankruptcy process takes anywhere from 36 to 60 months.Chapter 7 takes four to six months.

May I ask why you are filing bankruptcy? Are you facing a lawsuit, a foreclosure, or just annoying collection calls?

Were you asking how long a bankruptcy would last because you are not sure for how long you are going to be able keep current with your payments or are you already past due with your accounts? What types of debt are you trying to get out of?

They meant well sir, they are asking you those questions because filing bankruptcy is usually not the first advice that any debt expert would give a consumer. Especially in your case, you said that what you have are credit card debts, those are considered unsecured debts--which means that they can be negotiated with the creditors, they can be instead settled. Are you behind on your payments? Are those the only debts that you have?

Okay Mister Laissez-faire, for your credit card debt, try debt settlement instead as they have suggested, that is if your credit amount is $10,000 and above plus you are already in default. What debt settlement can do is try to cut that amount to at least half while you are saving up money to pay what the creditors and the debt settlement company have agreed upon.As for your 401(k) understand that the repayment terms may differ according to what your reason was for getting a loan against it. If for example, you borrowed from your retirement for a down payment on a house, your employer may allow you 10 to 15 years to repay that loan. It can be lower...have you started paying back this loan? How many years do you still have to complet it?
