Why are there debt settlement attorney's in Florida? What is so special about debt settlements there?

In Florida, not only are the collection agencies prohibited from further contacting the consumer with regards to debt collection, but also the creditors. That law does not extend to other states. Other states only limit the harassment from collection agencies and not the original creditor.

Just to clarify what Order Chiroptera has said, when the consumer has already sent the collection agency a cease and desist letter, the collection agency is already not legally allowed to contact the consumer--and in Florida, that legal protection is extended to the original creditors.

So..an enrollment in a debt settlement program in Florida automatically stops the collection calls? If your answer is no, is there where the debt settlement attorneys come in? I still don't get how though..

Okay here's how it goes, when you enroll in a debt settlement company in Florida, the collection calls might be reduced, but what happens if the collection calls persist? The debt settlement company, not being a law firm, cannot really help the client exercise the stated right (no harassment after the cease and desist letter)--so in comes the debt settlement attorneys.

You can say that Florida is a debt settlement friendly state because of that law as it gives the consumers a greater chance at settlement. However, the creditors still reserve the right to sue the consumer to obtain a judgment, which is another reason why there are debt settlement attorneys in Florida.

I agree with don'tyoushiver, and speaking of judgments, it can be any of the following:A bank levy - in which the creditor has the right to freeze and/or withdraw from any of your accounts.Property Lien - the creditor can obligate you to pay them from the proceeds of the sale of your property or if you refinance it. Worst case scenario is the creditors selling your property.Wage garnishment - the creditor takes a percentage of your salary until the debt is satisfied.

In the even that the creditors were able to secure a judgment against the consumer--In Florida the "heads of household" are protected or the bread winner. Their wages cannot be garnished --unless he/she has failed to file for what's called the Head of Household Exemption. Another special feature for debt settlement attorneys in Florida is the 100% homestead protection that the state law provides in the event of a creditor securing a lien against their client.  That is assuming that the consumer was able to file for a homestead exemption
