Should I File Bankruptcy Quiz

Posted on July 15, 2009 at 4:37 am
I thought I'd start this. A bankruptcy quiz! Questions to ask yourself before filing or if you even have to as it's not for everyone.-are you only able to pay the minimum amount monthly?-are you forced into charging for food and gas?-are you almost or at your limit with your cards? If you answered yes to all...bankruptcy is not for you. Try credit counseling or debt settlement instead.

How is filing from a community property state relative to the - should I file bankruptcy quiz?

It has something to do with the bankruptcy estate and how it affects the non-filing spouse. This could be considered part of the - should I file bankruptcy quiz:Will filing bankruptcy in a community property state affect the non-filing spouse? The bankruptcy will only affect the non-filing spouse unless the debt that is being petitioned for-- is joint. The court though will ask for the non-filing spouse's financial situation like salary and assets to determine which bankruptcy type is going to be granted the filing spouse. This also goes for Chapter 13. While the non-filing spouse will not be involved with the repayment plan, the court would still ask for his/her financial situation. Each spouse has their own individual credit report and the non-filing spouse's credit history will not directly reflect on the filing spouse's bankruptcy petition--unless they have joint debts.
