Can I Tell Them Whatever I Want?

I'm gonna do this on my own. If I bullshit them during the negotiation process (tell them that I'm living in my grandmother's shed, etc), is this a problem? A couple years ago the fine people at Disc card called me trying to beg it out of me, and told me "even if you file for bankruptcy (ch. 7) successfully, you have to pay the debt back." I have to admit, they had me for a minute. Apparently, however, it is ok for them to BS someone...

Do you own a home and pay a mortgage? If so, that would appear on your credit report and the creditor would be able to see that and know you are lying. Also, filing Chapter 7 does not necessarily mean you get a "clean slate" as most people assume. You would be forced to turn over any non-exempt property to the court appointed trustee who is handling the case. The property would then be sold, and the proceeds would be used to pay back a portion (sometimes all) of the dbet that you owe. I understand you are frustrad but please refrain from using profanity on the forum.

No, I own no home. I still have basically nothing to my name that they could or would see of value. (I understand that about ch. 7 - but they were trying to tell me I'd have to repay the whole debt, even if I filed ch. 7. They were well aware that I, a lowly college student, had nothing.)So the question is: do the things I tell them to arrive at the settlement have to be true?

I am sure you could lie to them if you wanted to go that route and potentially settle the debt regardless. However, let me ask you, if you do not own a home what is the point of telling them you live in your grandmother's shed?

I was being facetious (sp?). I just mean to exaggerate my circumstances. My aim is to clear it out for as little money as possible.
