Debt Collectors Calling My Cell Phone!!

The collection agency has to send you a letter withing five days after they've first contacted you about the debt. The letter has to contain the amount you owe, your creditor information, and your right to have the debt verified. If they fail to send you that letter in 5 days, that's the time to write them a cease and desist letter--if they contact you again regarding the same debt, you may tell them that you are reporting them to the FTC or the police.

were you also asking how to write/send the letter? After writing that you are requesting for them to stop contacting you or calling your cell phone, make a copy of your letter and keep it. Send the original letter via certified mail, and pay for a return receipt-- so you’ll know and have proof that the collector received it. Once the collector receives your letter, they should not contact you again,---Unless  to tell you that there will be no more contact  from them or to let you know that they have or the creditosr are stating the intention of taking e a specific action against you--, like filing a lawsuit.

what happens if after the cease and desist letter was sent and recived, i'd be receving calls still

Failure to acknowledge a written request to stop the calls already means that they've violated federal law. Of course what you can do is file a complaint with your state's Attorney General and provide proper documentation regarding the action.

can a debt collector call my cell phone? for real? that's not fair. i have my number unlisted. i hope they still won't call that

ladyinwaiting - if they have found the information on your credit report (which they can legally pull out), they are authorized to contact you there, regardless of a request to render it unlisted.

You may instead opt to use a privacy guard to screen the calls--or better yet, as suggested earlier--write a cease and desist letter.

One thing you also need to keep in mind is this: you still have responsibility for the debt even if you've requested that all calls be stopped. They will only honor your request but they still may pursue collection efforts--and an individual may still be sued in spite of the request for no contact.

is there any way that i can prevent them fron suing me altogether? just because i don't want phone calls on my cell? get real.
