Hello, I am considering filing bankruptcy and I learned that I'd have to go through credit counseling first. Is the credit counseling course in California any different from the other states?

can i do this over the phone or online, can i even get exempted from it? how much does it usually cost?

Yes I think you can do it by phone or online and if you are filing as an individual the fee is (may vary) $50. If you're filing with your spouse it's double (subject to the agency), as for the exception, not unless you have a serious illness/disability or overseas serving the military can you be exempted..and even if those were the case, since remote counseling is available, I don't think you can dodge it.

Since it's a pre-bankruptcy requirement, meaning there is a chance that you might opt not to file, but still need help in resolving your financial situation, as you would learn from the credit counseling course, there are alternatives to bankruptcy.

To add to what pocketfulofsunshine said, that there's a chance that you might not file bankruptcy at all, actually one of the purposes of credit counseling is to enlighten you as to the alternatives to bankruptcy. The government would prefer the consumer to resolve his/her financial issues out of the bankruptcy courts as it costs them both time and money.

Austen j- have you made any progress? I know you were looking for credit counseling for bankruptcy in California but are you sure filing bamkruptcy would be your best option right now? Would you care to share your situation?

Yes it sounds like you may be jumping the gun but I am not too sure. Are you behind on payments? Is that why you feel the need to file? Did you lose your job recently or something like that.

Can I file for bankruptcy in California even if I don't currently reside there? I mean most of my assets are there and I am a bit confused, I just relocated that's why I'm asking this question
