Why are there debt settlement attorneys in California?

Perhaps to help the debt settlement industry avoid any unauthorized practice of the law? Especially if the state has its own interpretation of the Fair Debt Collection Practices Act...

to defend against collection lawsuits and other legal-related issues that might arise from debt settlement cases. money transactions, as you know, can at times, be ugly. debt settlement attorneys both have the consumers and the non-attorney debt settlement companies as their clients.

ok..what's so special about California? Also, can attorneys operate a debt settlement company or act as a consultant in a non-legal field? Is debt settlement considered a legal-related business? Are debt settlement attorneys like bankruptcy attorneys in the way that their practice is limited to their respective specialty? Is there a limitation or exemptions?

I am not sure about this - but I think what's special about California is that an attorney can practice law and operate a debt settlement business too, provided he/she has the knowledge to advice clients about the alternatives to bankruptcy, debt management, of course debt settlement, the FDCPA, the collection procedure (including the issue of judgments against the client). Also, I think, again I'm not sure, in California a debt settlement company is not considered a law practice...so the attorney can practice both a law firm and a business firm provided that the debt settlement attorney does not have a non-lawyer partner...Can somebody verify these?

If you're in California and you're not facing legal action, you don't really need a debt settlement Attorney to help you with your debt. A regular settlement company would do.

A debt settlement company usually has an attorney as a consultant, not just in California, but nationwide.
