Paid Off One Collector, Get Contacted By Another For The Same Debt!

About 3 years ago I had a US Bank account that overdrafted, and I couldn't cover the charges.  2 years later I get a call from DMK Associates about the debt, I pay it off, the total was about 280 dollars, I paid it and went along with my business, this was in the summer of '08.  Now I get a call from another collector (Everest) saying I owe another 108 dollars on the same US Bank account.  Now the other collection agency told me I owed 280 dollars and I paid it, so how can this other company come to me saying I owe another 100 bucks?Everest told me that I didn't finish paying off 50 dollars on the account, so it of course sits and gains interest, now I owe 100 dollars.  I inform Everest that I did pay this off, completely, or was led to believe that.  They say I need to get confirmation from DMK or send them my letter that I recieved LAST YEAR (which I no longer have, I was stupid to throw it away).  I'm going to call DMK on Monday to hopefully get them to sort it out, but I'm doubtful they will.It seems to me that DMK only had me pay off most of the debt, only to let it accrue interest and sell the debt off to Everest.  Isn't this illegal?  It seems pretty fraudulant to me.  Advice?

Yes, that's definitely illegal, but the problem is it doesnt sound like you have the paper trail to support your case.  Have you gotten your free credit report for this year?  I'd pull that and see what it says with the debt.  I'd also request a debt validation from Everest.  If you contact them in writing requesting information about the account within 30 days of your first communication, they have to supply it.   http://www.payingpaul.com/debt-validation-letter.php (debt validation letter)  http://www.annualcreditreport.com  (free credit report)

I got my credit report, and the debt doesn't show up there on Experian.  I just got off the phone with DMK Associates and they confirmed that I did pay the debt off in full, so they're now sending me the letter so that I can forward it to Everest Asset Management, it SHOULD be all cleared up.Man my blood got to boiling when I got a call a year later about a debt I had already paid off, and that it accrued interest.  I'm just glad that DMK was honest, and it should be taken care of.Thanks guys!
