Would bankruptcy get in the way of adoption? What are the issues that I should watch out for?

It would maybe depend on your financial standing now and also the adoption agency's requirements. Just as long as you are able to pay for the adoption fee, and I assume that they would have a list of expenses for the baby, if you are able to meet those, then your bankruptcy history should not be an issue.

I agree that bankruptcy does not really matter in the adoption process-granted that you are financially back at your feet-and can prove that you are able to support the needs of the child.There are even cases in which an adoptive couple was able to begin their homestudy on the same month of their bankruptcy discharge.

It is a law on all states for the potential adoptive parents to attend a mandatory course, which lasts for 3-6 months, depending on the agency, attorney or the court. The course evaluates the adoptive parent's desire and commitment to the child, it is also for them to explore their deeper reasons for adopting, it also so that they may be evaluated by the facilitator as prospective parents-if they are suitable, and of course, the course provides the prospective parents the know-hows of caring for adoptive children.

From what I understand a person (or couple) would not be denied the right to adopt solely because they had filed bankruptcy in the past. Some adoption agencies may ask the inerested person(s) to provide them with a copy of the bankruptcy discharge papers. Other agencies may ask the person(s) to provide them with a list of their income and expenses so they know that the adopted child will be entering into a home that will be able to provide for he or she. And of course, any adoption agency will want to know how the adoption costs will be covered, so as long as you are financially stable at the time you are trying to adopt you should not have any problems as a result of a past bankruptcy filing.
