I am getting calls for an old Capital One account that I think is in collections. I was stupid and got into some debt after graduating from college. Anyways these people won't stop calling on Sundays and I was wondering if they are even allowed to do this?

The Fair Debt Practices Act (FDCPA) does allow collectors to call you on Sunday. However, they cannot contact you before 8 AM or after 9 PM (your local time) so if they are calling outside of those hours they are in violation of the FDCPA. I also read somewhere that Idaho is the only state where debt collectors are not permitted to call on Sundays. Is this true? Can anyone confirm? Also, if this is the case are there any other states that this applies to?

I do not know too much about the calls on Sundays, but there is some interesting information in regards to collection matters and Idaho. Idaho is a "one-party consent state", and if I understand that correctly if you reside there you can record any conversation you have with a debt collector without asking their permission to do so first. You would be the consenting party and as a result under the Idaho State and Federal Call Recording Laws have permission to do this. This may be helpful if you are dealing with harassment from a debt collector and live in Idaho.
