My Family Members Are Receiving Calls From Debt Collectors!!!

It's crazy! i've moved from PA to AZ and ive been hearing from these people!@ and they have been harrassing my father and my stepmom! both are elderly and my dad's under medication already and they keep on disturbing the peace in their household! is there anyway that they can stop!??!

unwell,Are your parents aware of the debt that you incurred? Did the debt collectors mention anything about this matter to them? Because if the collection agency's representatives did that, they are committing a violation of the FDCPA. Debt collectors are not authorized to inform third parties about the nature of their calls--they can only speak with the account holder himself (and co-signers, if any). They cannot state that they are calling from a debt collection agency and why they are calling.

Hi, unwell. . . Under limited circumstances, debt collectors can contact your family members, but only for purposes of acquiring contact information from you. As caffeinatrix mentioned earlier, the debt collectors cannot disclose information on why they are attempting to reach you through them. In fact, debt collectors can contact any individual to verify or correct the information they have about you. Debt collectors are not allowed to contact these third parties more than once--that is, if the third party asks for a callback, or if the debt collector has reason to believe that the family member provided wrong or inaccurate information about the debtor.

i don't want my parents to know abt it either. my stepmom says they're not saying anything but she suspects that it's a debt collection agency. so now my question is, whats the exact information that these guys can tell my folks/

The debt collector may only ask for location information. I'm assuming that the reason why they're trying to contact your parents way back in PA is because they can't get ahold of you in AZ. If you really want the calls to stop once and for all, write them a Cease and Desist letter, stating your concern. You may inform them that you no longer wish to receive any calls from them whatsoever. In the same way, tell them that you only wish to hear from them in writing.

It's also possible that your former creditor's records aren't updated which is why they've been calling your parents incessantly. Or the information that they have about you isnt enough.Just to add to what Karess said, too, a debt collector is not allowed to call third parties (including family, friends, and even employers) IF they know how to reach you firsthand and IF they know that you have an attorney to represent you. If they have been calling and getting in touch with you in AZ and still persisting to contact them in PA, there might be something fishy going on

If debt collectors are contacting your family members, including minors, to find out how to locate you, here are some things they should do:1. As stressed earlier, disclose why they were calling2. Identify themselves by name (but not as debt collector)3. Identify the name of the company they're calling from only when askedThey cannot leave infortmation about the debt on your family member's voice mail or answering machine. In the same way, under the FDCPA any contact with a third party is regarded as the same as contact with the debtor.

oh and quick question, unwell: at what time are the debt collectors calling your parents? Coz they're not allowed to call them before 8AM and after 9PM their time. i suggest that the next time you get to speak with your parents, ask them what time they call and what the collectors ask or inform them. get details on the collection agency. have you tried negotiating with them?
