Mr. Jones- Chapter 7 Bankruptcy stays on your credit report for 10 years, while Chapter 13 stays on your credit report for 7 years. However, I am not too sure if that is from the time the bankruptcy petition is filed or from the time the bankruptcy is discharged. Does anyone know?

A Chapter 7 bankruptcy will stay on your credit report from 10 years from the file date. The same may apply for Chapter 13 but typically the notation may be removed 7 years after it was filed.

Mr. Jones- Also, if you are struggling with unsecured debt issues, you may want to consider the fact that bankruptcy stays on your public records for 20 years. Bankruptcy alternatives such as credit counseling and debt settlement do not appear on your public records at all. If you don't absolutely have to file bankruptcy, I would consider one of the alternatives first. A credit repairing company representative i spoke with over the phone the other day said they can remove that bankruptcy of mine. now i am confused.

Only the passing of time will remove a negative notation on your credit report. Credit reporting agencies can never remove any negative or inaccurate information appearing on their client's credit reports. The company you're working with has just made a misleading statement and you may just need to stay away from working with them.

But how long does bankruptcy stay on your credit report for if you have a voluntary dismissal?

I think that a dismissed bankruptcy stays on your credit report the same way as when it's received a proper discharge.

Not only that, I am not too sure about this, but I think that your creditors are free to, once again, collect from you the original amount that you owed them before your bankruptcy.

What is the reason why the creditors can, once again, try to collect on the original amount of debt? And is that legal?
