I have already filed once, unfortunately got myself back into trouble. My girlfriend and I were buying too much stuff on my credit cards and after awhile it got totally out of control, she lost her job and and I now realize I cannot pay it back.

Hey Smitty-It depends on what chapter you filed in the past.If you filed Chapter 7, and wish to file Chapter 7 again, you must wait a period of 8 years.If you filed Chapter 13, and wish to file Chapter 13 again, you must wait a period of 2 years.On the other hand, lets say you filed Chapter 7 awhile back, and now you want to file Chapter 13- you would have to wait 4 years to do so.Have you considered any of the bankruptcy alternatives that are out there such as credit counseling or debt settlement? Depending on your situation, these may be effective methods for you to use in order to get out of debt without filing again.

Ok, so I filed Chapter 7 about three and a half years ago. I now have some credit card debt that I want to settle. Do I have to wait a certain amount of time before I can enroll into a debt settlement program? Please advise!

Nikki, you don't need to wait for a certain period of time for you to apply for a debt settlement program. You can actually fill out a form up top so you may be able to know more abt it.

Although it would not be easy, B. Smitty you can pay them back if you stop charging on those cards now, and if you start communicating with your creditors about your financial situation.You can request for them to freeze or reduce the interests on those cards at least until you get back on your feet. Try to work out a repayment agreement with them and make sure that you pay on time.Bankruptcy should be your last option as you already had one. Although you can file for another one, it would be very harmful to your credit report, so try other options this time, like credit counseling or debt settlement-- repayment is your only issue at the moment and not yet a lawsuit.

Nikkigreen you may enroll in a debt settlement program if your debt is $10,000 and above and your accounts past due. Debt settlement companies will usually charge 15% of the total debt amount and spread the fees out over 18 months. Or, they will take a percentage of the settlement amount, usually between 20-25%.
