Who Should File Chapter 13?

That, I am not sure. A word of caution though if the businessman is using a credit counseling agency...make sure that the payments, if ever the creditors accepted the repayment proposal, reach them. If the credit counseling agency fails to do its job the consumer might end up staring at a bankruptcy filed by the creditors instead.

Chairman's right. Aside from that, the consumer might end up falling further behind on payment.

Is it possible that from wanting to file for Chaptter 13 bankruptcy a consumer would instead opt for a credit counseling?

It is possible to want to do credit counseling instead of Chapter 13- but have you filed  yet?

Great! Then I'll go thru with the counseling then. I havent filed for Chapter 13 because I know what it can do to my credit score. I was just curious as to what can be done. I wanted to see what options I have.

I'll just consolidate my debts thru a counselor.
