Who should file Chapter 13? Perhaps, those consumers who initially had a relatively low debt amount (less than $10,000) but after an unsuccessful try with a DMP - have somehow found themselves in a deeper hole, ex: a possible lawsuit.

Who should file Chapter 13? I think consumers don't have that big a chance anymore with Chapter 7 anyway..so, I guess most of those who are filing bankruptcy anyway.

You cannot file for Chapter 13 bankruptcy for your business, under its business name. However, you can be able to file for Chapter 13 if your business is a sole proprietorship, and you do not want to liquidate it in a Chapter 7 bankruptcy.

You may also want to consider filing Chapter 13 bankruptcy if you're a business owner, on the grounds that your unsecured debts are less than $336,900, and your secured debts are less than $1,010,650.

Also, it can be done if you've previously filed for Chapter 7, within the last 6 years.

I think so although I am not too sure. A Chapter 13 should only be considered though if all sorts of structuring have already been tried. Filing bankruptcy might not save the business.

I am not very well versed with business restructuring but from what I know - the business owner would still have to see a finance, debt, or credit consultant for it. Where can they be found? With the Better Business Bureau and look for counselors that are licensed by the American Board of Certification.

The businessman afterwards, can present his/her proposal to the creditors -- that or have a lawyer or the credit counselors represent him/her.

You mentioned a lawyer and credit counselor, how about debt settlement for business? Does that exist?
