I filed a Chapter 7 ten years ago...with my ex-wife. She did all the work so I basically have no idea if it was filed in our names, if so well would it affect my filing another one...do I need to contact her for this?

Ten years ago for Chapter 7 gives you the go signal to file for another one.
A Chapter 7 requires another 7 years to pass before you can file another one. Your wife doesn't have to figure in it, but you may need your own lawyer to guide you through the paper works. There would be a lot of paper work and some meetings-- because the bankruptcy law has been revised in 2005, do expect some changes in the procedures, but don't worry your attorney can explain them all to you.Instead of calling your wife, look for a bankruptcy attorney.

Chapter 13. Where you don't need to lose your properties.

I would lose my properties in Chapter 7? I thought bankruptcy means that I tell the government that I can't afford to pay my debts anymore--and they come in and help me by pardoning them. I don't know how. Maybe out of the people's taxes. I pay my taxes. So...I am entitled to it.

wow you really weren't there when your wife filed bankruptcy. i wonder if your wife was there when you accumulated all those debts. anyway, since you sound genuinely lost. in chapter 13, you would have to submit a repayment plan, the court would have to approve it, and you have to be faithful to the plan until it gets all paid off. unlike in chapter 7, your properties will be handed over to a court appointed trustee, the trustee would arrange for them to be sold (converted into cash) then distribute the proceeds to your creditors.i hope you don't plan on filing for a third one, my friend.

Yes, if 10 years has passed then you're fine to file bankruptcy again. You won't necessarily lose your property in a Chapter 7 - it depends on what your property is worth and what state you live in. This is usually best to discuss with an attorney, but most people who dont have assets that are worth a lot don't have to liquidate anything in Chapter 7.
