Can a collection agency garnish wages or freeze a bank account over non payment in the state of nc?

A collection agency? I don't think so. The government or state- yes they can. I am pretty sure a collection agency cannot garnish anything. You owe a debt- but it's not legal to take it out of your check.

I would have to agree. I do not think they can do that. The only way they garnish your wages is if you owe back taxes, child support, and a few other government money that you may owe.

Nobody can garnish your wages unless a court gives them an order of garnishment. Even the government needs an order of garnishment. Granted they get it pretty fast but even they need one. If you've been threatened by a collector w/garnishment, have him/her send you a letter stating they will garnish if you don't pay. That is a direct violation of the law and they know it but some are so arrogant they will actually send you this type of letter.

and the state where the debt originated.

i had the same problem over a truck payment. They wouldnt deal with me because i knew the laws. so they would call my husband at work get him all upset telling him they were going to garnish his wages. I immediately called them told them they could no longer call my husband at work or he would be fired, if they did i was going to sue them(they are not allowed to call work without your permission) second I told them they were not allowed by law to garnish his wages without court order and that this was a loan with collateral that if they wanted the truck come and get it but not to harrass my husband any longer or they would never see another dime and i would have them in court. take charge if you rattle easily tell them they can only contact you by mail from that point on. these are ruthless people and they will say anything to get you going even if its illegal because they assume you dont know better.

If the collection agency takes you to court and the judge grants the judgement, the collection agency can garnish your wages. However, you cannot fall below poverty guidelines if the garnishment goes through. If you already have a garnishment in effect, another garnishment cannot be put into play at the same time.

@kayeshayne21 - are you posting in here just to post? Of course they can garnish wages!! Please read my above post - I have worked as a supervisor at a collection agency and it was my job to know the rules/regulations an processes. Please do not give information in these situations if you do not know. The original posters in here are looking for useful, factual information to help them!

Okay I know I look like I just want five cents but I just wanted to say GO MARMIS! I am tired of seeing stupid comments so someone can earn five cents. What happened to the moderators that are supposed to delete useless comments? However to be honest I don't think that kayeshayne is guilty of this, I think she is guilty of not reading the entire thread before she posts, which might be just as bad.

Ok...so if you can help me... I was never made aware of a court date about taking any money from me. However, now they have taken all I had in my checking account and after that, in Dec 08 there was a judgement recorded with the court but not until then and it has gone over the statute of limitations which is 6 yrs in MN. Now they are trying to garnish my wages and I know my employer will have to comply but what about the court date I never received? Just trying to stay calm in my own horror movie!
