Wrongfully Charged?

My parents are heavily in debt and have been for as long as I've been alive (20 years). Debt collection companies are constantly hounding them over the phone and in the mail. I, on the other hand, am not in debt. However a collection company took all of the money out of my account, thinking that I was my Dad. My dad and I have the same exact name by the way. I received a "notice of levy" that is directed towards both my mom and dad. It is clear to me that they thought that my Dad had two separate accounts and must have decided to take money out of his other account (which is actually my account).

I now owe 90 dollars that I don't have at the moment, to the bank. I am also financing a laptop for 31.74 a week. That money wasn't able to be taken from my account, thus hurting my credit and trust with this financing company. My question is, would I have a lawsuit against this collection company that wrongfully took money out of my account?
