Credit Cards in my name

Over a year ago I opened two credit cards in my name using my social for my girlfriend at the time (who had bad credit) to use. She maxed out both almost immediately but was making the minimum monthly payments. This continued until I left her, at which time she stopped making payments, leaving me with a total of about $3400 worth of debt. Both cards are in my name alone, making me legally responsible to the credit card companies to repay the debts, but do I have a civil lawsuit against my ex?  Any help would be greatly appreciated.

She's the one you need to be talking with about this.  The bad thing about financing spenders, as you learned from hard experience, is that they will just keep spending.  Spending money is an addiction and some people can't break the habit. You might have to threaten her with a lawsuit in small claims court to recover your money. You might pose the argument in small claims court that the credit card was a loan that she had agreed to repay. And, when she stopped paying, she breached the agreement. Unless you can get her to cooperate and compromise and help you pay these off, I think you're stuck with the debt since the cards are in your name. :-(

I agree you may be able to take her to small claims court. Was she signing her name on these receipts? Did you have her on the account as an authorized user? If so that helps  your case. If not, you could still threaten to take her to small claims to see if she is willing to work some payments out to you. If she agrees to this make sure to get it in writing, with a witness (you might even consider paying a notary to witness) signature, so if she stops paying you back before everything is repaid, you will have something to produce in court.

i think if it has your name on it then it is up to you to pay of the debt associated with it, sorry i know this is not what you wanted to hear

Well i don't think Credit card will hear our site as you own card in your name and she made transaction when u know her very well and all happened when u r their so no will trust u but u can convience your EX Girlfriend and tell her to pay credit card payment.

I forgot to ask.  Did you cancel the credit cards? I'm wondering for a reason.  Your ex could still use the credit cards to buy stuff online or pay her bills online as long as she knows the credit card number and the security code and date of expiration. She could order stuff online and then have it shipped to a "friend" (herself) and you would have to pay. So please cancel the credit cards.

That is pretty bad that you gave out your trust like that without having organised  a pay back plan with her. But I guess you will learn from your mistakes and never allow someone else to use your card.

If the purchases made on the credit card were for her own uses, such as clothing, jewelry, buying time on her cellphone, things that can be traced back to her,  you may be able to prove that you're not responsible for the entire balance. However, it's a long shot in court, because the argument would be that she was an authorized user on this account. If you jointly paid all expenses,  and used this credit card to pay off bills while living with her, you might have a case. Maybe..

Talk to her nicely, maybe she 's still willing to pay you.
